Re: Implant settlement victim – Judy Caranna

I am writing to you to let you know how I feel about the way you and your bureaucracy have handled the breast implant settlement that my wife, Judy Caranna, has applied for.
She had the implants inserted several years before the “hidden” memo appeared that proved that DOW knew that silicone could cause devastating damage to humans. My wife was guaranteed by her plastic surgeon that the implants were harmless, permanent, and would last forever. She never would have considered it otherwise.
Since that evil day, her health has deteriorated to the point that she is unrecognizable when compared to her pre-implant state of health. We have suffered unimaginable hell for over five years now. I have literally watched her dying a day at a time.
Now we are at the point where, after watching the settlement shrink to a dime on the dollar, the women who are seeking the long-term settlement (my wife included) are being subjected to another assault on our intelligence. She has been told that if she accepts the small, lump sum settlement now she will get her money almost immediately. If, however, she opts for the long-term settlement she will have to wait some indeterminate time for you to determine if she qualifies and how much she qualifies for. There is no mechanism for her to obtain any information of any value whatsoever in order to make plans for some kind of life while she is still alive. She is forty-one (41) years old.
She was one of the most beautiful, graceful dancers on this planet. Now she is a disfigured cripple. She is dying. She is depressed. You are not helping.
It is unconscionable to add insult to the injuries she has already suffered.
Let me put it this way. What if I come to your house and cut off your breasts. It would alter your life. Then you find out that I am politically powerful, richer than god, and am only concerned with preventing you from ever achieving anything resembling justice.

I am sending a copy of this letter to Judge Pointer. I would like to infirm him that he has a moral duty to protect victims of DOW chemicals criminal behavior. He has not only let them down, but appears to be nothing more than a clerk doing the bidding of a perfect criminal enterprise.
Al Capone could not have damaged my wife more for money. The only difference is that our mega-corporations are above the law. It is bad “public policy” to have DOW compensate victims for the deliberate, criminal acts of those “executives” who perpetrated this nightmare. The women are obviously expendable.
I only wish I could “expend” all of you that way. Every minute of every day I watch my wife suffer. I am without my wife as she should be. How far do you think you can really go? How invulnerable do you think you really are?
You and Pointer are part and parcel of a system that not only demands contempt, but is totally responsible for the incredible amount of anger and justifiable cynicism that rules our world.
My life, my wife’s life, my children’s lives have been forever damaged. The perpetrators have all gotten away with what should be capital crimes. I dealt with, and have all the documentation necessary; to put all of them in jail but it won’t happen because the system is rigged. That is why I have lawyers in the family now. In a police state, be sure you’re a cop. Lawyers are a protected class used by the “King” to do his dirty work. Attorney’s who defy this system and try to help people are harassed and removed if at all possible. Why do you think the Kennedy’s are lawyers now? All of them are doing what I have done with my boys and brother. It is for our survival, not yours.

In 1988 I worked for the Niroda Corporation, located at 11821 SW 57th Ct., Miami. Zevi Vigdor, one of Israel’s top 100 businessmen, owns it. We did our "transshipping" from the Customs Clearance & Dispatch Warehouse, located at 6300 NW 74th Ave., Miami, FL 33166. Raul Cazadillo owns it. I ate and spent a great deal of time with Zevi's entire family. His wife even tried to fix me up with her sister Rachael. I learned what Israel was really all about. Zevi's son, Niv, used to laugh at the warehouse workers who were all sweaty and dirty. He said many times, "God made those monkeys to do the menial labor so we can enjoy life."
We helped Wal-Mart buy goods earmarked for export from the US. American companies, like Borden’s, will sell to third world markets the same products we buy at deep-deep discounts. The citizens of those countries cannot afford to pay a dollar for a can of evaporated milk so Americans subsidize those countries by paying artificially high prices at home. The products purchased at Wal-Mart are double subsidized. You have already subsidized the products you buy at Wal-Mart for a few cents less than the mom and pop store. You are actually paying twice for that can of milk while putting yourselves and neighbors out of business. The Wal-Mart family thanks you for their 100 billion dollars.
What we did was use foreign contacts (fake importers to be precise) to order a container of Borden Condensed Milk. We took delivery of the container from Borden at the Miami customs warehouse. We pulled out the contents and shipped it to Wal-Mart, etc. A private shipper named Bill Coleman loaded the contents in his tractor trailers and delivered the milk to Phar-mor, or any discount house. I shipped an empty container to the country it was supposed to go to. The paper work, signed by the Customs agent, stated the container was full. Israel was a favored port. Panama, Caracas, Australia, Dubai, U.A. Emerits, etc. There were over thirty ports that were corrupt and in the network.
These aren't terrorists. These are you're public officials at work. The profit made from undermining American consumers and small businesses goes straight into the pocket of Zevi, Niv, and the Wal-mart family so you can sweat for slave wages and they can laugh at you. I made twenty thousand dollars a month just brokering the goods for them to Wal-Mart, etc. When I gathered enough contacts to start an export business of my own I quit. They went ballistic and threatened to kill me. I was paid ten thousand dollars to not discuss their business. I didn't because I was making as much money as they were doing the same thing.
We have seen the effects these secret transactions have had on American mom and pop businesses and on weapons shipping. All of this was done under the protection of US Customs. You could not enter the warehouse without clearing customs. The Customs Officer’s only other duty was to personally distribute the contents of one container that came in once a week. It contained cow-pie shaped blocks of what looked like brown sugar but so hard it was impossible to break up by normal means. It looked a lot like the heroin I've seen. He said it was a special sugar. It was a joke. It was heroin and he was the only one allowed to go near the trailer. I, being the charming guy I am, befriended him and got to go into the trailer.
The Miami Blacks always believed it was true anyway. It's like the Kennedy reputation. We knew at the time about everything through the grapevine. It was only the official word from media that took years to admit what they knew all along. The E-Grapevine now tells the whole world everything in real time by doing an end run around the propaganda machine.
The Palestinians (MECCA) will never have the same opportunity to subvert American citizens and import weapons to fight fair. Jerusalem should become a theme park dedicated to remembering the evil that the three religious gangs have wreaked on the planet for thousands of years by exploiting fear and ignorance. If those crumbling ruins aren't vaporized first, that is what will happen eventually. The death and destruction they pour on the monkeys they use for labor is irrelevant to them. Mass media generates mass money. The FCC erased the public from the money part of the equation in the 40s. The landmark Communications Act of 1934 began with good intentions. The latest Telecommunications Act of 1996 destroyed the last hope of equity and is heading to a monolith of propaganda for corporate oligarchs and political criminals.
Cash is the key to the problems; cash is the key to the solutions. It is inherent in the system as it is today that a few privileged groups become super-rich while “normal” people lose ground. ADA
The Americans with Disabilities Act is the least understood and under used set of laws in America today. When implemented as a defense, or as an affirmative action, it has the effect of putting mercy into the justice system and healthcare to the forefront. The Act was implemented in the early 90’s by the Bush administration as part of a treaty package with nations joining the first Gulf War coalition.
It is mostly known as being used to put in wheelchair ramps and other accommodations. It goes much deeper than that. Current Federal law states that police officers arresting a suspect have an affirmative duty to determine if that individual has a mental or physical disability, and if they are capable of understanding why they are being arrested. An ADA coordinator should be present to make the determination and appropriate treatment be provided. A judge has the same duty.
My brother is an attorney with learning disability. He has become a practitioner of ADA law in Tampa, Florida by necessity. His wife, who passed the California Bar twelve years ago, also has some learning related disabilities. Both implemented ADA to force the Florida and California Bars to recognize and accept that they were public entities subject to ADA rules and must grant accommodations according to law. My brother gets time and a half to prepare or answer legal motions
In the quest for more knowledge they have found that there is virtually are no law school courses or continuing legal education for ADA law. It is rarely used by attorneys and is met with contemptuous rage by judges and attorneys not versed in the law. It is Federal practice, cumbersome and expensive, and they hate it. It also forms a nexus between the legal and medical communities that has not previously existed. As stated above, it puts mercy in the justice system and healthcare to the forefront. That is an anathema to current methods of legal practice.
I have seen a client about to be deported for making a mistake on an application form saved because she was under medication at the time and not responsible for the error. Another client with multiple sclerosis, whose former attorney was unsuccessful in recusing a hostile judge, finally implemented ADA rules. The Judge recused herself and has to deal with the violations she previously may not have understood. She now understands ADA.
Many institutions, such as the courts, churches, state agencies, and many others not readily thought of as covered facilities are covered under Title II, and Title III of the Act. It should, and probably will, force churches to decide whether to stop certain activities or give up the church designation and tax exemption given to churches.
The Church of Scientology recently held a member in their health care facility. They have developed a relationship with the local Circuit Court so that if a family member feels their loved needs to be baker acted to get them away from the “Church”, the Court refuses to Baker Acts them and returns them to the Church mental health facility. This makes them a public facility under ADA and not a church. They are liable under laws that churches usually are able to avoid. They lose their designation as a church and tax exemption.
Implementation of ADA rules by the family’s attorney might have saved her life and made great strides in piercing the veil of church designation (it is essentially a learning center with associated facilities)
If ADA was implemented in the Terri Schaivo case it could make a great deal of difference. Lawyers involved on both sides are beginning to understand the value. They both have been in communication with the firm for consultation. The Attorney General has had a great educational experience this year with ADA. The value of the ACT is finally sinking in, in Tallahassee.
Contracts signed by a person medicated and unable to properly comprehend the full implications of signing may be able to have the contract voided if ADA procedures were not implemented proper to signing. There is an affirmative duty by the parties to do so.
It is a given that anyone who is sick automatically qualifies under ADA. If you need a doctor it is incumbent on the system to provide proper care. Denial of care is a violation. Telling someone they, “don’t look disabled”, is a violation. Retaliation by an angry public official or private entity for demands made by disabled persons is a violation.
All of these carry strong sanctions and often leave public officials personally liable for damages.
That is a nightmare to a system already strapped for cash and facing a tsunami of claims and lawsuits. It should effectively force a healthcare system that would be cheaper to publicly fund than defend against. Federal mandates are not often welcome by State authorities and this has been met with particular resistance. It is expensive and gives a great deal of power to the medical community to inject the needs and rights of individuals in public facilities, including the Courts.
Rush Limbaugh could implement ADA by virtue of his addiction and probably stymie any criminal sanctions. It would also be a great topic for him to explore. It is a Republican backed ACT that would be very useful to him in his recovery. The attention on his addiction and lack of verity could be channeled into a positive lesson for the nation. The treatment Rush has been getting should be the norm and with the ADA could be. It is a health issue, and ADA keeps it that way. It also makes it necessary for the state to promote treatment or face non -compliance in so many areas the courts will be overwhelmed. He could start a healthcare revolution and salvage both his health and career.
These are examples of the various affects ADA laws have on almost every aspect of public life involving the legal and medical communities and all public facilities. It is what will ultimately bring a healthcare system and legal system together to, I repeat, put mercy in the justice system and healthcare to the forefront. It is long overdue. The lack of legal education is appalling and problematic. The resistance attorneys implementing the laws too often find is coercive and in itself a violation of the Act.
The media is also uninformed and often not interested in stories about ADA. A recent article in the St. Petersburg Times by reporter Terri D. Reeves, tells of the opening of a Broadway Play depicting the real life story of a woman named Dee Sutton, who was awarded an honor by the President for work with the disabled. She developed Multiple Sclerosis and faced all the problems and frustrations built into the system. What is needed is to teach the public how the ADA could have made her journey much less tragic. That was not a part of the article. It is not hard to understand the resistance to spreading the word or even teaching the law to new lawyers. The ACT was implemented as part of the Gulf War coalition and not something that was a hot topic at the time. Had the coalition partners in Europe not demanded compliance, it probably wouldn’t be current law. Efforts have to be made to promote education and compliance by the entities already under a duty to do so.
These issues are vital to the survival of the dream of a country ruled by law, where those public officials sworn to uphold and obey the law, actually do.

In 1988 I worked for the Niroda Corporation, located at 11821 SW 57th Ct., Miami. Zevi Vigdor, one of Israel’s top 100 businessmen, owns it. We did our "transshipping" from the Customs Clearance & Dispatch Warehouse, located at 6300 NW 74th Ave., Miami, FL 33166. Raul Cazadillo owns it. I ate and spent a great deal of time with Zevi's entire family. His wife even tried to fix me up with her sister Rachael. I learned what Israel was really all about. Zevi's son, Niv, used to laugh at the warehouse workers who were all sweaty and dirty. He said many times, "God made those monkeys to do the menial labor so we can enjoy life."
We helped Wal-Mart buy goods earmarked for export from the US. American companies, like Borden’s, will sell to third world markets the same products we buy at deep-deep discounts. The citizens of those countries cannot afford to pay a dollar for a can of evaporated milk so Americans subsidize those countries by paying artificially high prices at home. The products purchased at Wal-Mart are double subsidized. You have already subsidized the products you buy at Wal-Mart for a few cents less than the mom and pop store. You are actually paying twice for that can of milk while putting yourselves and neighbors out of business. The Wal-Mart family thanks you for their 100 billion dollars.
What we did was use foreign contacts (fake importers to be precise) to order a container of Borden Condensed Milk. We took delivery of the container from Borden at the Miami customs warehouse. We pulled out the contents and shipped it to Wal-Mart, etc. A private shipper named Bill Coleman loaded the contents in his tractor trailers and delivered the milk to Phar-mor, or any discount house. I shipped an empty container to the country it was supposed to go to. The paper work, signed by the Customs agent, stated the container was full. Israel was a favored port. Panama, Caracas, Australia, Dubai, U.A. Emerits, etc. There were over thirty ports that were corrupt and in the network.
These aren't terrorists. These are you're public officials at work. The profit made from undermining American consumers and small businesses goes straight into the pocket of Zevi, Niv, and the Wal-mart family so you can sweat for slave wages and they can laugh at you. I made twenty thousand dollars a month just brokering the goods for them to Wal-Mart, etc. When I gathered enough contacts to start an export business of my own I quit. They went ballistic and threatened to kill me. I was paid ten thousand dollars to not discuss their business. I didn't because I was making as much money as they were doing the same thing.
We have seen the effects these secret transactions have had on American mom and pop businesses and on weapons shipping. All of this was done under the protection of US Customs. You could not enter the warehouse without clearing customs. The Customs Officer’s only other duty was to personally distribute the contents of one container that came in once a week. It contained cow-pie shaped blocks of what looked like brown sugar but so hard it was impossible to break up by normal means. It looked a lot like the heroin I've seen. He said it was a special sugar. It was a joke. It was heroin and he was the only one allowed to go near the trailer. I, being the charming guy I am, befriended him and got to go into the trailer.
The Miami Blacks always believed it was true anyway. It's like the Kennedy reputation. We knew at the time about everything through the grapevine. It was only the official word from media that took years to admit what they knew all along. The E-Grapevine now tells the whole world everything in real time by doing an end run around the propaganda machine.
The Palestinians (MECCA) will never have the same opportunity to subvert American citizens and import weapons to fight fair. Jerusalem should become a theme park dedicated to remembering the evil that the three religious gangs have wreaked on the planet for thousands of years by exploiting fear and ignorance. If those crumbling ruins aren't vaporized first, that is what will happen eventually. The death and destruction they pour on the monkeys they use for labor is irrelevant to them. USF hung Sami Al Arian out to dry. Today the St. Pete Times said the new USF president is to be the highest paid in the nation. We are in trouble. When a twenty-seven year old Palestinian attorney straps a bomb around her broken heart and takes her nightmare to her enemies, she is Joan of Arc. We are the terrorists. Mass media generates mass money. The FCC erased the public from the money part of the equation in the 40s. The landmark Communications Act of 1934 began with good intentions. The latest Telecommunications Act of 1996 destroyed the last hope of equity and is heading to a monolith of propaganda for corporate oligarchs and political criminals.
Cash is the key to the problems; cash is the key to the solutions. It is inherent in the system as it is today that a few privileged groups become super-rich while “normal” people lose ground. It creates envy, greed and a lust for gold. The disparity between the income of hard working people is so great is discounts vital professions and injures the soul. Its effects on the political system alone are enough to want radical change BACK to original thinking. During WWII, the FCC froze everything and rewrote the rules. The commercial and propaganda value was apparent and too hard to resist. The public got sold out.
The mass-money mass-media produces could, and should, fund health and education. It may seem commie, but what we have now is worse. The revolutionary measure would solve several problems and cure our bodies and souls in the process. It is not commie, it is the ORIGINAL intent. What we have now is just plain criminal.
There really is no alternative. The present medical system is so corrupt, and causes so much horror and grief; the Marquis De Sade would wince.
Reagan’s FCC chairman, Mark Fowler, said, ”TV is just a toaster with pictures. It doesn’t need much regulation”. Nothing could be further from the truth. Since then it has been a giant trough for mega-media monopolies that threaten our democracy.

The five billion wretched souls on this planet better get some hope for themselves or they will swarm like ants over the honey-pot the super-rich want all to themselves. ADA
The Americans with Disabilities Act is the least understood and under used set of laws in America today. When implemented as a defense, or as an affirmative action, it has the effect of putting mercy into the justice system and healthcare to the forefront. The Act was implemented in the early 90’s by the Bush administration as part of a treaty package with nations joining the first Gulf War coalition.
It is mostly known as being used to put in wheelchair ramps and other accommodations. It goes much deeper than that. Current Federal law states that police officers arresting a suspect have an affirmative duty to determine if that individual has a mental or physical disability, and if they are capable of understanding why they are being arrested. An ADA coordinator should be present to make the determination and appropriate treatment be provided. A judge has the same duty.
My brother is an attorney with learning disability. He has become a practitioner of ADA law in Tampa, Florida by necessity. His wife, who passed the California Bar twelve years ago, also has some learning related disabilities. Both implemented ADA to force the Florida and California Bars to recognize and accept that they were public entities subject to ADA rules and must grant accommodations according to law. My brother gets time and a half to prepare or answer legal motions
In the quest for more knowledge they have found that there is virtually are no law school courses or continuing legal education for ADA law. It is rarely used by attorneys and is met with contemptuous rage by judges and attorneys not versed in the law. It is Federal practice, cumbersome and expensive, and they hate it. It also forms a nexus between the legal and medical communities that has not previously existed. As stated above, it puts mercy in the justice system and healthcare to the forefront. That is an anathema to current methods of legal practice.
I have seen a client about to be deported for making a mistake on an application form saved because she was under medication at the time and not responsible for the error. Another client with multiple sclerosis, whose former attorney was unsuccessful in recusing a hostile judge, finally implemented ADA rules. The Judge recused herself and has to deal with the violations she previously may not have understood. She now understands ADA.
Many institutions, such as the courts, churches, state agencies, and many others not readily thought of as covered facilities are covered under Title II, and Title III of the Act. It should, and probably will, force churches to decide whether to stop certain activities or give up the church designation and tax exemption given to churches.
The Church of Scientology recently held a member in their health care facility. They have developed a relationship with the local Circuit Court so that if a family member feels their loved needs to be baker acted to get them away from the “Church”, the Court refuses to Baker Acts them and returns them to the Church mental health facility. This makes them a public facility under ADA and not a church. They are liable under laws that churches usually are able to avoid. They lose their designation as a church and tax exemption.
Implementation of ADA rules by the family’s attorney might have saved her life and made great strides in piercing the veil of church designation (it is essentially a learning center with associated facilities)
If ADA was implemented in the Terri Schaivo case it could make a great deal of difference. Lawyers involved on both sides are beginning to understand the value. They both have been in communication with the firm for consultation. The Attorney General has had a great educational experience this year with ADA. The value of the ACT is finally sinking in, in Tallahassee.
Contracts signed by a person medicated and unable to properly comprehend the full implications of signing may be able to have the contract voided if ADA procedures were not implemented proper to signing. There is an affirmative duty by the parties to do so.
It is a given that anyone who is sick automatically qualifies under ADA. If you need a doctor it is incumbent on the system to provide proper care. Denial of care is a violation. Telling someone they, “don’t look disabled”, is a violation. Retaliation by an angry public official or private entity for demands made by disabled persons is a violation.
All of these carry strong sanctions and often leave public officials personally liable for damages.
That is a nightmare to a system already strapped for cash and facing a tsunami of claims and lawsuits. It should effectively force a healthcare system that would be cheaper to publicly fund than defend against. Federal mandates are not often welcome by State authorities and this has been met with particular resistance. It is expensive and gives a great deal of power to the medical community to inject the needs and rights of individuals in public facilities, including the Courts.
Rush Limbaugh could implement ADA by virtue of his addiction and probably stymie any criminal sanctions. It would also be a great topic for him to explore. It is a Republican backed ACT that would be very useful to him in his recovery. The attention on his addiction and lack of verity could be channeled into a positive lesson for the nation. The treatment Rush has been getting should be the norm and with the ADA could be. It is a health issue, and ADA keeps it that way. It also makes it necessary for the state to promote treatment or face non -compliance in so many areas the courts will be overwhelmed. He could start a healthcare revolution and salvage both his health and career.
These are examples of the various affects ADA laws have on almost every aspect of public life involving the legal and medical communities and all public facilities. It is what will ultimately bring a healthcare system and legal system together to, I repeat, put mercy in the justice system and healthcare to the forefront. It is long overdue. The lack of legal education is appalling and problematic. The resistance attorneys implementing the laws too often find is coercive and in itself a violation of the Act.
The media is also uninformed and often not interested in stories about ADA. A recent article in the St. Petersburg Times by reporter Terri D. Reeves, tells of the opening of a Broadway Play depicting the real life story of a woman named Dee Sutton, who was awarded an honor by the President for work with the disabled. She developed Multiple Sclerosis and faced all the problems and frustrations built into the system. What is needed is to teach the public how the ADA could have made her journey much less tragic. That was not a part of the article. It is not hard to understand the resistance to spreading the word or even teaching the law to new lawyers. The ACT was implemented as part of the Gulf War coalition and not something that was a hot topic at the time. Had the coalition partners in Europe not demanded compliance, it probably wouldn’t be current law. Efforts have to be made to promote education and compliance by the entities already under a duty to do so.
These issues are vital to the survival of the dream of a country ruled by law, where those public officials sworn to uphold and obey the law, actually do.
